SunGreen Systems, Inc (“SunGreen,” “we,” “us,” or “our”) is a California Corporation.  This Privacy Policy describes how we collect, use, transfer, and disclose Personal Information from visitors to our website at https://www.sungreensystems.com (the “Site”) and by other means, such as via email or phone, as well as your rights regarding your Personal Information.  When you submit Personal Information to SunGreen, you are consenting to the collection, use, transfer, and disclosure of your Personal Information as described in this Privacy Policy.  If you have questions about this Privacy Policy, please contact SunGreen using the contact information located at the end of this Privacy Policy.

1. Information We Collect.

SunGreen collects your information, including Personal Information, from various sources as described below.  “Personal Information” includes any information received by SunGreen that could reasonably be used to personally identify you or be linked to you.

1.1. Information You Provide Directly to Us.  If you choose to contact us through the Site or otherwise correspond with us, you may be asked to provide your name, agency/organization, email address, phone number, and any other information or content you choose to provide directly to us.

1.2. Technical Information. We may collect information about how you and your device interact with the Site, including, for example: (1) referring source (i.e., the site you visited prior to visiting our Site); (2) date and time of access to our Site; (3) site pages visited and our Site features used, and the order of use; (4) type of computer or other operating device accessing our Site, type of browser used to access our Site, and type of operating system you use; and (5) other similar information about the interaction between your browser and our Site.  We collect and store technical information through information gathering tools such as cookies, web beacons, and other similar technologies.  

1.2.1. Cookies.  In some cases, SunGreen may use cookies for technical reasons in order for the Site to operate. Cookies are small data files that may be placed on your computer or mobile device when you visit a website or use your mobile device. Cookies are widely used by website and application owners to make the website and application work more efficiently and to provide reporting information. SunGreen may employ the use of cookies for internal purposes to ensure that the Site can function and is available for your use and access, however, SunGreen does not employ any other cookies or tracking technology, including but not limited to for the purpose of targeted ads.  The cookies are managed by SunGreen and not a third-party. You can set your browser or mobile device to refuse all or some cookies, however, the cookies that SunGreen employs are essential and if you set your browser or mobile device to refuse such cookies, the Site may not be available to you.

1.2.2. Web Beacons.  We may use web beacons (also called clear GIFs or pixel tags) or similar technologies to collect technical information about your use of our Products and your viewing and use of emails we send to you.  Web beacons are graphic image files imbedded in a web page, Site feature, or email that provide a presence on such web page, feature, or email and send back to its home server information from the visitor’s browser.  The information collected by web beacons allows us to statistically monitor how many people are using our Site and opening our emails, and for what purposes.  For example, we might place a web beacon in a marketing email to notify us when a visitor clicks on the link in the email.  We do not collect Personal Information with web beacons, and we do not link information retrieved from web beacons directly with Personal Information you have given us.

2. How SunGreen Uses Your Personal Information.

We will process your Personal Information for the purpose stated when we ask for such Personal Information.  We also use Personal Information as described elsewhere in this Privacy Policy and to send you communications.

2.1. Communications. We may use your Personal Information to respond to your requests for information, to notify you about changes, to provide you information about SunGreen Products that may be of interest to you, and in any other way we may describe when you provide the information.  Where required by law, we will provide you with information about the SunGreen Products only if you have opted-in to receiving such information. We will never share your Personal Information collected from our website or by other means described in this document with a third party for their own marketing or independent uses, except: (1) where you consent to such information sharing and (2) as described in this Privacy Policy.

If we use your Personal Information to send you marketing communications, we will provide you with an unsubscribe mechanism to opt-out of receiving future marketing communications, or you can contact us to request that we not send you marketing communications. If you request that we not contact you for marketing purposes (either by using the unsubscribe mechanism or contacting us), we reserve the right to contact you for non-marketing purposes such as responding to a direct inquiry we receive from you.

2.2 Providing and Supporting our Site.  We may use Personal Information to help diagnose problems, to make our Site more compatible with the technology used by our visitors, to analyze statistical use patterns, and to otherwise develop, improve, and provide our Site.

Required by Law.  SunGreen reserves the right to release your information if SunGreen believes in good faith that (i) such release is required to comply with any law, rule, or regulation, or any search warrant, subpoena, court order, or similar legal process; or (ii) disclosure is necessary to protect or enforce SunGreen’s rights or property, to protect the rights or property of others, to protect your safety or the safety of others, in emergency situations, to defend against legal claims, to enforce our contractual or other rights, or to take action regarding illegal activities or suspected fraud.

5. Third Party Websites.  

Our Site may contain links to third-party websites, software, content, or services (“Third Party Websites”) that are not owned or controlled by SunGreen. SunGreen has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any Third Party Websites. In addition, SunGreen will not and cannot censor or edit the content of any Third Party Website.

6. How SunGreen Protects Your Personal Information.  

SunGreen uses commercially reasonable physical, technical, and administrative safeguards to preserve the integrity and security of all information collected through our Site.  However, SunGreen cannot ensure or warrant the security of any information you transmit to SunGreen or guarantee that information we collect may not be accessed, disclosed, altered, or destroyed.  

7. Children’s Privacy.  

Our Site is intended for a general audience and SunGreen does not knowingly collect Personal Information from children under the age of 18. If we learn that we have collected such children’s Personal Information without parental consent, we will delete such information from our system. If you learn that your child has provided us with information, please let us know.

8. Updates.  

Please visit this Privacy Policy from time to time, as SunGreen reserves the right to periodically update it. Your continued use of our Site and communications with us after an update to this Privacy Policy indicates your acceptance of the terms of the updated Privacy Policy.

We retain your Personal Information for as long as is needed for the purpose for which it was provided, or for as long as we are permitted to under applicable law, including as may be necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and protect the security of our Site.  We may create and retain deidentified data for use for lawfully permissible purposes.
